Breaching a Court Order The Case of Keeley Lake Lodge and Pamela Dietrich

According to the Saskatchewan Corporate Registry (ISC) report from January 31, 2023, one of the directors of Keeley Lake Lodge is Pamela Dietrich. However, a court order issued on February 25, 2021 by The Hon. Mr. Justice N.G. Gabrielson stated in “Section 2: Sub section A” that Pamela Dietrich had to be removed as the cabin attendant or otherwise as an employee of Keeley Lake Lodge (1989) Ltd.

Directors hold a greater level of responsibility for a company than managers, and if a court order has removed an employee based on their lack of qualifications, it is unclear how they could be qualified to be a director. In fact, in “Section 11”, Hon. Mr. Justice N.G. Gabrielson stated that Pamela Dietrich was not suitable for the position of interim manager of the Lodge.

In this case, Madelyn Niessner, the wife of Charles Niessner, a 40% shareholder of Keeley Lake Lodge, not only put the company’s reputation at risk, but also defied a court order. When a court issues an order, it is legally binding and must be followed by the parties involved in the case, regardless of their personal opinions or beliefs. It is considered a serious offense and can result in various legal consequences, such as fines or even imprisonment.

“To win a conviction, the Crown prosecutor must prove the order existed and that you had no reasonable excuse to breach it”. The proof of the violation is the Court Order, which was issued and signed by Hon. Mr. Justice N.G. Gabrielson on February 25, 2021. Madelyn has not yet been questioned regarding the breach of the order, and it remains to be seen whether she can provide a valid excuse for her actions.

A video recording from May 3, 2023, shows Pamela Dietrich currently running and operating Keeley Lake Lodge. Also, when questioned about her position as Director on the ISC report Ms. Dietrich stated she did not know she was on the court order. When asked about the ISC report, Ms. Dietrich chose not to answer. Overall, the defiance of the court’s order should shed light on the entire Keeley Lake Lodge case and question Madelyn Niessner’s reliability. This begs the question: what consequences will Madelyn Niessner face for her actions?
