    Grant Scharfstein’s Outrageous Email: Questioning Jurisdiction and Defamation Tactics

    Grant Scharfstein sent an email on May 3, 2023 to his clients Madelyn and Charles Niessner, as well as Tony Merchant, Tim Cimmer’s lawyer, and Niessner’s lawyer in the United States, Gregory Lomax. The email is attached as evidence and wrongfully states to defame Mr. Cimmer’s character, yet again. Scharfstein claims Mr. Cimmer was intimidating and harassing the staff at Keeley Lake Lodge and claiming to terminate staff. Mr. Scharfstein brings up the New Jersey Court Order that specifies “Cimmer is permanently enjoined from: holding himself out as an owner of the Lodge and entering the lodges premises’ ‘. Mr. Scharfstein needs to be reminded this is Saskatchewan and New Jersey holds no jurisdiction here and no order has been made in Saskatchewan in regards to this.

    Personally this is ridiculous and amusing to myself considering Mr. Scharfstein is a professional and should not have his only defense, as an order that holds no jurisdiction here. His only argument is the New Jersey order and none of his own research or findings. Mr. Scharfstein’s attempt to defame Mr. Cimmer’s character based on the New Jersey order lacks credibility and relevance. His conduct is highly inappropriate, and should not be tolerated.

    Scharfstein goes on to write about the court order issued by Hon N.G. Gabrielson on January 29, 2021. The order states “ Charles, Madelyn Niessner and Timothy Cimmer are restrained and enjoined from dealing with the property and assets of the lodge or interfering in any way, the Managers in the discharge of their duties and exercise of their powers herein.”

    A video recorded on May 23, 2023 captures Charlene, the Manager of Keeley Lake Lodge, being questioned about the lodge’s renovations and whether Madelyn was sent the request. Charlene responded, “Yes, I did.” Instead of Mr. Scharfstein defaming Mr. Cimmer’s character and claiming that he is breaching a court order with no jurisdiction here, he should ensure that his client is not engaging in similar behavior.

    Furthermore, it is essential to acknowledge that Madelyn Niessner is in violation of a court order from Saskatchewan, as emphasized by Mr. Scharfstein in his email. Regardless of whether Mr. Scharfstein is aware of his client’s current violation of the Saskatchewan court order, it is crucial to take appropriate measures to hold Mrs. Niessner accountable for her actions.
