It all started with shocking accusations made by three siblings, Michael, Michelle, and Kathleen Ross, alleging sexual abuse within their family circle. Despite the lack of solid evidence, legal action was pursued vigorously.</span></p><p><span style="font-weight: 400;">On</span> <span style="font-weight: 400;">July 10, 1991, charges were brought against 16 individuals, including the children&#8217;s biological and foster parents, based on the siblings&#8217; claims. However, as the case progressed, it became evident that the accusations were unfounded. However, this extreme lack of evidence was ignored since many different individuals were prosecuted despite their innocence. Michael, the primary accuser, was revealed to be the actual perpetrator, exploiting his sisters and fabricating stories to deflect blame.</span></p><p><span style="font-weight: 400;">Following the failed prosecution, the accused families sought justice through a lawsuit for malicious prosecution filed in 1994. To give a bit of background, the court set out four conditions for a successful malicious prosecution claim: the defendant must initiate the prosecution, it must end in favor of the plaintiff, it must lack reasonable cause, and it must be motivated by malice. In this case, only the last two conditions were in question. This legal battle stretched over a decade, eventually reaching the highest court in Canada.</span></p><p><span style="font-weight: 400;">The Supreme Court grappled with the nuances of the case, ultimately ruling in favor of the prosecutor, Matthew Miazga, citing a lack of concrete evidence of “malice.” Despite this legal outcome, questions persisted regarding the fairness of the proceedings and the impact on the families involved. Criminal cases burden innocent people with emotional, social, and financial costs. They endure public shame, job loss, and mental health struggles. The Saskatchewan government paid the Klassen family $2.736 million for pain and legal costs, but they still suffered greatly from false accusations, even years later. Despite being proven innocent, the Klassen family already lost their reputation due to this unfair trial.</span></p><p><span style="font-weight: 400;">After all was said and done, Miazga received recognition for his role in the case, sparking controversy and renewed scrutiny. Matthew Miazga was awarded the Courage and Perseverance Award in 2010 for his role in these sensitive cases. Critics raised concerns about honoring a prosecutor whose actions had contributed to a grave miscarriage of justice and wasted millions of taxpayer money. His actions had caused damage to multiple lives, and at the end of it all, he received an award for falsely accusing innocent people without “malice.”</span></p><p><span style="font-weight: 400;">Today, as Matthew Miazga still continues his work as a Crown prosecutor, the aftermath of this case serves as a reminder that the justice system is not perfect. It is marred by people like Mr. Miazga, who celebrate exercising power over the innocent, and being lauded for being “courageous” instead of receiving proper repercussions.</span></p>								</div>

This isn&#8217;t the first time the Niessners have skirted Canadian law, raising doubts about their credibility. A 2017 Global News report exposed Willard (Charles) Niessner, fined and banned for illegal hunting in Saskatchewan. Now locked in a legal battle, the Niessners seek to legitimize forged documents in Canada, exposing the fragility of the Canadian legal system.</span></p><p><span style="font-weight: 400;">The victim in this legal drama is Tim Cimmer, the majority shareholder of Keeley Lake Lodge. Cimmer&#8217;s emotional investment in the lodge, rooted in cherished family memories, has morphed into a prolonged legal tussle due to the alleged falsification of business records by the Niessners and their lawyer, Gregory Lomax. Despite clear evidence of Cimmer&#8217;s 60% ownership, government agencies like SLGA, ISC, and CRA have failed to question the legitimacy of the documents, leaving a pressing question: What safeguards are in place to prevent future fraud against Canadian-owned businesses?</span></p><p><span style="font-weight: 400;">The tendrils of corruption extend further as SLGA employees, Rohan Swaby and Laurie Jacobson, allegedly accepted unregistered and fraudulent documents, further facilitating the falsification. Jacobson&#8217;s breach of the Foreign Judgments Act, allowing the Niessners to file as 100% owners, adds a layer of negligence that demands accountability. Tony Merchant&#8217;s letter to Jacobson emphasized the insignificance of a New Jersey judgment in Saskatchewan, urging her to correct her records. Jacobson&#8217;s failure to act raises concerns about the potential erosion of integrity within government institutions.</span></p><p><span style="font-weight: 400;">While these cases unfold on Canadian soil, the ripple effects of corruption reach global giants like Nestle. This is exactly what Rohan Swaby, Manager for the Saskatchewan Liquor and Gaming Authority failed to follow. Rohan Swaby, along with Laurie Jacobson, a Licensing Specialist for the SLGA accepted foreign documents resulting in falsified records to be filed with the SLGA. Ms. Jacobson enforced the Foreign Judgments Act without the proper authority to do so. The US judgement was never registered in Saskatchewan and without a doubt is not enforceable here.</p><p>A letter sent to Laurie Jacobson on July 12, 2022 by Tony Merchant states,<a href="#evidence"><u> “A judgement from New Jersey is not of any consequence in Saskatchewan”.</u></a> Ms. Jacobson took it upon herself to let Charles and Madelyn Niessner file as 100% ownership of Keeley Lake Lodge, illegally stripping Tim Cimmers 60% ownership. Tony Merchant informed Laurie Jacobson that she needed to <a href="#evidence"><u>“properly correct her records and if she had any doubt about the issue to contact Civil Law Branch or whatever law firm SLGA retains”</u>,</a> she failed to do so. Ms. Jacobson disregarded the letter and breached the Foreign Judgments Act which states “<strong>A party seeking to have a foreign judgement recognised and enforced must commence new proceedings in the domestic court, either by action or application”</strong>. The Niessners did not register the New Jersey judgement in Saskatchewan, but Ms. Jacobson illegally accepted it anyway.</p><p>Laurie Jacobson is employed by the SLGA and has zero jurisdiction to make legal decisions on behalf of the Saskatchewan Government. Rohan Swaby and Laurie Jacobson have been negligent with filing these unregistered and fraudulent documents through the SLGA and need to be held accountable by the proper authorities.</p>								</div>

<p>An American couple following Trump’s lead with allegedly falsifying business records. No investigation has been launched following these accusations, although the proper authorities were informed. Falsifying business records rises to a crime when the “intent to defraud includes an intent to commit another crime or to aid or conceal the commission thereof.” Under Canada’s law,“forgery is complete as soon as a document is made with the knowledge and intent.” Both laws are directly applicable to the story covered in this article involving an American couple. Their intent was to defraud our Canadian government and illegally assume all control of a Saskatchewan business.</p>

<p>This isn&#8217;t the first time this American couple has not complied with Canadian law, which should put into question their credibility on all other legal matters. A Global News story published in 2017,  an American man was fined and banned for illegal hunting in Saskatchewan. The man in question was Willard (Charles) Niessner, a Wisconsin resident. Interestly enough Charles Niessner (wife, Madelyn Pauly) own and operate a business in Saskatchewan, <strong>Keeley Lake Lodge. </strong>An unjustified lawsuit filed here in Canada by Mr and Mrs Niessner back in 2016 against the majority shareholder Richard Luneman seems to have no end in sight. The Saskatchewan man involved, Tim Cimmer purchased all shares from Mr. Lunemann in 2016, making Mr. Cimmer majority shareholder at 60%. Prior to the sale of the shares, Richard Lunemann and Tim Cimmer signed a Share Option Agreement and Demand Loan agreement which was made effective on December 11, 2015. For the past 7 years Tim Cimmer has been defending himself against these fraudulent claims and unjustified actions. When I sat down with Mr. Cimmer I became intrigued by his selflessness and reasoning for buying into the business Keeley Lake Lodge in the first place.</p>

<p>Tim Cimmers parents vacationed at Keeley lake before and after having kids. Some of his first memories were the quality time spent with his parents and sister at Keeley Lake Lodge. Portions of the lodge are built on the property owned by Mr. Cimmers parents. I asked what purchasing the lodge would mean to him, he told me he was inspired to do so because of his parents and the community around Keeley. The sentimental value it held to him and his family and the friends he had acquired over the years at the lodge, he wanted to see it thrive for generations to come. Also, Mr. Cimmer stated that he intended on surprising his parents with their perfect idea of a place to retire at. This was an emotional investment and kind gesture turned into a spiteful and tiring legal battle.</p>

<p>Business records falsified in the states by the Niessners and their lawyer Gregory Lomax were then filed to the SLGA, ISC and CRA, yet no government employee within these businesses questioned the legitimacy of the falsified business records or acknowledged Mr. Cimmer’s 60% ownership. What is stopping other US citizens from defrauding other Canadian owned businesses or the Government of Canada in the future with fabricated documents? This intense legal battle is coming up on 8 years yet no end is in sight. In order to protect Canada&#8217;s legal system from unlawful actions caused by non-canadian citizens, appropriate measures by government officials are required to investigate this issue.</p>

<p>Since the Niessners won their US suit against Mr. Cimmer and Mr. Lunemann with forged documents. They are now trying to pass these illegal documents and falsified business records as legitimate in Canada. The Foreign Judgments Act states “ a party seeking to have a foreign judgement recognized and enforced <strong>must commence new proceedings in the domestic court, either by action or application. </strong>Given the history of neglect Mr. Cimmer has experienced by Canada&#8217;s government employees, there is clear distrust that injustice will occur following the Niessners suit. Mr and Mrs. Niessner along with their lawyer Lomax and Scharstein  conducted the perfect scheme with fraudulent business records to invalidate Mr. Cimmer’s 60% ownership of Keeley Lake Lodge in both the eyes of the US and our government.</p>

<p>These unjustified, illegal proceedings by the Niessners need immediate attention by the proper authorities to prevent Charter Violation to Mr. Cimmer under our constitution. If such actions were to occur this will prove to non-canadian citizens how flawed and breakable our justice system is and put at risk other Canadian owned businesses.</p>
